Terms of Service

Preamble

These Terms of Service ("Terms") apply to all orders placed on the popout.page website (the "Site") published by David PAVLOVSCHII, Sole Proprietor, operating under the trade name Doved Studio, SIREN 851 542 167, domiciled at 200 rue de la Croix Nivert, 75015 Paris, France (the "Provider").

Any order implies unreserved acceptance of these Terms.

Article 1 - Object

These Terms govern the sale of services offered by the Provider on the Site, including:

• Portfolio Hosting: Free and paid portfolio hosting plans
• Custom Domains: Ability to connect your own domain
• Pro Features: Advanced analytics, priority support, and enhanced visibility

Article 2 - Pricing

Prices are indicated in euros (€) including all taxes. The Provider is not subject to VAT (article 293 B of the French Tax Code).

Current pricing:

• Free Plan: Basic portfolio with popout.page subdomain
• Pro Plan: Custom domain, analytics, priority support

The Provider reserves the right to modify prices at any time. Applicable prices are those in effect at the time of order validation.

Article 3 - Order and Payment

3.1 Order Process

The order is validated after:

• Selection of the desired service
• Entering billing information
• Acceptance of these Terms
• Full payment

3.2 Payment Methods

Payments are made via Stripe, a secure online payment platform. Accepted methods: credit card (Visa, Mastercard, American Express).

3.3 Subscription

Pro subscriptions are billed monthly or annually. Subscriptions automatically renew unless cancelled before the renewal date.

Article 4 - Service Execution

4.1 Portfolio Hosting

Hosting services are provided according to the following terms:

• Immediate access after payment validation
• Portfolio accessible 24/7 (subject to maintenance)
• Regular backups of your data

4.2 Custom Domains

Custom domain configuration is available for Pro subscribers. DNS setup instructions are provided in the dashboard.

Article 5 - Right of Withdrawal

5.1 Exceptions to the Right of Withdrawal

In accordance with article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for:

• Digital content: If you have expressly consented to immediate execution and waived your right of withdrawal
• Services begun: If the service has started before the expiration of the 14-day period with your express agreement

Article 6 - Refund

6.1 Refund Delay

In case of valid withdrawal, the refund will be made within a maximum of 14 days following receipt of the request, via the same payment method used for the order.

Article 7 - Liability

The Provider commits to providing services with diligence and professionalism.

Limitation of liability:

• Portfolio availability is subject to hosting provider uptime
• The Provider cannot be held responsible for indirect damages
• Content published on portfolios is the sole responsibility of users

Article 8 - Intellectual Property

The Site and its features are the exclusive property of the Provider. Users retain ownership of their portfolio content but grant the Provider a license to display it on the Site.

Article 9 - Data Protection

Personal data collected is processed in accordance with GDPR. For more information, see our Privacy Policy.

Article 10 - Complaints and Mediation

10.1 Customer Service

For any complaint, contact us at: hello@dovedstudio.com. We commit to responding within 48 business hours.

10.2 Mediation

In accordance with articles L.611-1 et seq. of the French Consumer Code, in case of unresolved dispute, you can use the consumer mediator free of charge. Contact details will be provided upon request.

Article 11 - Applicable Law

These Terms are governed by French law. In case of dispute, French courts will have sole jurisdiction, subject to mandatory consumer protection provisions more favorable to the consumer.
